Terms of Service

1. Who you are contracting with

NQ Backtest ("the Service") is owned and operated by Elior Dabool (trading as NQ Backtest). When you use the Service or buy a membership you are entering into an agreement with Elior Dabool. Contact: hello@nqbacktest.online.

2. Acceptance

By accessing or using the Service, you agree to these Terms of Service. If you do not agree, do not use the Service.

3. Nature of the Service

The Service is a simulation and educational tool for practicing trading strategies on historical market data. It is not a brokerage, exchange, or investment advisory service. No real money is traded through the Service.

4. No Financial Advice

Nothing on the Service constitutes financial, investment, tax, or legal advice, and nothing here is a recommendation to buy or sell any instrument. Market data, AI-generated coaching, gradings and summaries are for general educational purposes only, may be inaccurate or delayed, and any decision you take in live markets is your own responsibility.

5. Account & Eligibility

You must be at least 18 years old and provide accurate account information. You are responsible for safeguarding your account credentials and for all activity under your account.

6. Acceptable Use

You may not (a) use the Service unlawfully or fraudulently, (b) send spam or infringe anyone's intellectual property, (c) reverse engineer, resell or redistribute the Service or circumvent plan limits, (d) scrape our data or probe, attack or otherwise interfere with the security of the Service, or (e) upload malware.

Because the Service is trading education software, the following are also prohibited: (f) presenting the Service, its simulated results, its AI coaching or any screenshot or share card generated from it as investment advice, a signal service, a performance record of real trading, or a solicitation to invest; (g) using the Service to manage, solicit or pool other people's money, or to market a fund, prop-trading offer, copy-trading or signals product; (h) reselling access, sublicensing accounts, or redistributing our historical market data; (i) using the Service where trading-education software or the underlying market data is restricted by law in your jurisdiction; and (j) claiming any affiliation with, endorsement by, or licence from an exchange, broker, index provider or regulator.

All performance shown in the Service is simulated on historical data. Simulated results carry no commissions, slippage, liquidity or emotional pressure of live execution, and past market behaviour does not indicate future results. You are solely responsible for any decision you take in live markets, and for complying with the rules of your own broker and jurisdiction. We may remove content, restrict features, or suspend accounts that breach this section.

7. Licence & Intellectual Property

Elior Dabool retains all ownership of the Service, its software, data pipelines, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within the plan you selected. You retain ownership of the journal entries and drawings you create, and grant us a limited licence to host and process them solely to provide the Service.

8. Memberships, payment and billing

Pro and Pro+ are monthly subscriptions that renew automatically until cancelled. You can cancel at any time from the billing portal; access continues to the end of the paid period. Refunds follow our Refund Policy (14-day money-back guarantee). Payment, billing, tax, cancellation and refund mechanics are additionally governed by Paddle's Buyer Terms.

9. Reseller / Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Service level

We work to keep the Service available, but we do not guarantee uninterrupted or error-free performance. The Service is provided "AS IS" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

11. Limitation of Liability

To the maximum extent permitted by law, we disclaim liability for indirect, consequential or special damages (including lost profits, data or goodwill) and our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death or personal injury where the law does not allow it.

12. Suspension & Termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and delete your account at any time.

13. Governing law

These terms are governed by the laws of Israel, and the competent courts of Israel have exclusive jurisdiction, unless mandatory consumer law in your country of residence says otherwise.

14. Changes

We may update these terms. Continued use after changes constitutes acceptance.
